come up w/ something better than soft tissue injury - those heal in 3 to 6 weeks, w/ or w/o treatment (right LaurieMar?). need accident induced carpel tunnel or something good like that. My advice: try to settle directly with the other driver's insurance company for a fair amount - retaining an atty may get you more $$ but the atty will then take 1/3 so good chance you end up w/ less than doing it on your own.

Also your wkr comp will expect to be reimbursed from proceeds of settlement - in general car accidents are not a good way to get rich quick.
