Fred, if you have any info that backs up your claim such a lawsuit actually existed, I'd be real interested in looking at the facts of the case.
As for respect, you wouldn't get that from me just for being old, that would have to be earned. Your attitude, sweeping generalizations and overall conduct aren't making the mark in that regard. Thanks though for your well wishes, so far my life is pretty great!

Interesting, about the McD's case. If there was no notice, very likely a different outcome. As a defense attorney, we love when there is no notice because we can often get out of the case. I can't understand why McD's refused to pay the plaintiff's meds - wonder how much they were. McD's was in the wrong and should have stepped up to the plate early. Pay if you owe!

Your Honor Denny: On a serious note, do you have an opinion or comment on this: If a defendant in a civil suit files an MSJ and its denied and the Judge overrules all the evidentiary objections (with no rhyme or reason as most of them would have been excluded pre-trial based on sound law), the defendant then files a writ, what percentage of writs are granted? I did some research here in California, looking at the venue of this case -about 1 percent. Amazing. My Judge was a wacko and I heard that he has never seen a plaintiff he didn't like!

you're right on the notice issue, lack of notice would have made a difference in terms of punitive damages. It's my understanding that McD's settled the smaller cases, but didn't want to "set a precident" with injuries this substantial. I read a very indepth article on this case in some law journal - I'd like to see if I can find it again.
