Work in a middle school(grades 6-8). Hear real profanity almost every day. Each situation is different. Do the student and the teacher have a history with each other? Is the student showing off for his peers? Did dad/mom berate the student before he got to school? Is there any food in the home? There are so many issues that have to be considered. It is STILL difficult to be a kid.
If the Student code of conduct is vague, whether the student was being a pain or not, crap is not a profanity.
What kind of probation? School or court ordered?
AND I gotta agree with Steve. Lots of time homework is crap. I did mine cause it was easier than dealing with my dad, but it was still mostly crap.
Law, is he a good kid? Then save him.

Luvnlife and Bing Crosby have some very similar qualities. Once poster above (nameless for now) inadvertently(?) hit on one of them.

You certainly received lots of commentary Law, and I do not think I could add anything to the dialogue (or diatribe in one poster's case) to persuade your argument one way or the other. It's all pretty much been said.

I wonder if we would be even having this discussion if 1) the 15 yr old was NOT on probation or 2) and this may be a stretch, the 15 yr old was a white female whose father was a "well respected citizen"

I didn't represent the minor in the case that originally got him probation, so I don't know what that was all about. The alleged violation is that he failed to follow school rules.

windyw - I agree with all you said except the "is he a good kid part" I believe he deserves the best defense there is whether he's "good" or not. It's not my job to make moral judgments, it's my job to make sure the law gets followed and that my client is well-represented.

If the truth is irrelevant, why do we have to swear to tell it in court? The trouble with law and lawyers (I have friends who are) is president. My trial is MINE damn it not the culmination of centuries of mishandled, misunderstood, misinterpreted, and politically motivated fact manipulation.

Steve, you misread my post. I said "'truth' in that sense" meaning that even if the homework truly was a load of sh*t, my kid wouldn't be allowed to say that because that specific word is in the profanity category. Thus making the quality of the homework completely irrelevant to the language used by the student to comment upon it.

Also, spellcheckers have their limits - I think you meant precedent not president! laugh But you know I like you anyway!
