When you buy a property on AC you don't know which fees you are obliged to pay on your side, even if you have experience in the US or Canada. The fee structure is different.Some AC realtor's simply put their income taxes on your bill.That is sneaky but not exactly illegal, like a junk fee in the US.
My lawyer assures me that only becomes fraud if they tell you the law requires you pay this fee.I have been told this by more than one AC realtor. Just get up and leave the office. They may not know the law and be defrauding you by accident but an uniformed realtor is not your first choice with so many good ones around,


I know they all add on their GST on top of the commission I just wanted to know from Dane if this was legal? and does Dane add on GST as well?

It seems to me that Dane was describing some IRS info - which is not relevant or assessable here in Belize. Inplub is fully aware of the fees that are assessed in Belize.

The GST is assessed on the commission fee paid to the real estate commission. It is a legal assessment that is required by law = it is not negotiable nor is it is voluntary - it is mandatory. The gst is assessed on the commission rate paid to the real estate agent. It is also levied against legal fees which the attorney offices charge.

Many times it is a broker policy in their office, so they aren't even checking if it is legal.

The GST registered agencies on Ambergris Caye have to gross over $54K BZ per year. If you gross that much per year in commissions you are required by law to charge gst. That is a very simple law that requires that you charge gst on your commissions. Any agency that is not required to charge that law does not gross $54K Bz per year. There is nothing sneaky or untoward about the gst charge. It is plain and clear. Anybody that has done real estate busisness in Belize for the past 5 years or so is fully aware of how this system works.

I would like to take this moment to apologize to Amanda for anything I may have said early. Amanda is one of the best realtor's I know and I have known her for over 10 years. Amanda had explained everything and I already new as I had bought property in San Pedro. I was only fishing to see if anyone else new the law.

I would like to add, I had to place my property with one of the realtor's and Amanda was on top of the list for all the help she had given in the past. There are several other very good realtor's and they have been mention.

Inplub, I know and you know exactly how the GST is structured and applied - but I am wondering what Keller is trying to get at. Is it a dig at you or me?

In the meantime I believe that Dane now has some clarification on the various applications of GST and business tax as it pertains to real estate sales here. As with any country the tax system can lead on you on some very complicated pathways and it is a maze to figure it all out accurately. Danes business and my business have one huge difference that he may or may not choose to disclose on this forum.

I hesitate to post this as I don't have a 'dog in this hunt' but feel that I should remind everyone that you and your agent can agree to anything that is acceptable to both parties (so long as it is not against public policy or illegal) including having any taxes due be paid from what would otherwise be the agent's commission. Nothing nefarious, nothing sneaky just good old English common law of contracts at work.

The Belize taxation laws require that gst be billed to and paid by the client that pays the real estate commission. No ifs ands or buts. If anybody is conducting business in any other manner it is contrary to the letter of the law. We have been through this with the tax man, the accountancy association and the attorneys.

Although our laws are based on British common law we have our nuances.
