Hello, We have found ourselves in the same situation as timeshare owners.We were informed that Banyan Bay was sold but we have not received further information. Has anyone been successful in getting answers or resolutions?

There are laws in Belize that govern time-share ownership. I don't know how you will fare if you haven't met your side of the contracts which one owner stated - missing payments 3 times in a row. Although some may argue that they did not receive a bill, it is often in contracts that the owner should be aware of their billing cycles and make payments regardless of whether they receive notices. I am unfamiliar with the time-share contract but would suggest that one of you engage a Belizean attorney and know your rights. I hope you will all receive what you are owed.

We have a demand from Alaia that we release our timeshare as well.. Have not signed it yet but got an email form them wanting us to send the signed release, not sure if what they are doing is legal. We paid up front so our only obligation is the maintenance fee which we have never be late on. Our contract is for every year anytime, except Christmas and new year, ocean front and they are valuing it at $10k to buy us out.. But we have no option to keep our timeshare so kind off like getting robed and they return 10% of what the stole from you and that's supposed to be fair.

Who is your contact person at Alaia? We have a timeshare at Banyan Bay and hadn't heard anything about them abolishing the timeshares until we tried to secure our week for this year. We were told they no longer exist at Banyan Bay or whoever owns the properties now. We have a signed contract so I don't understand how this can be legal. There could be more of us having to deal with our timeshares being taken away, so any information helps us all.

To all timeshare holders at Banyan Bay,

My name is Gary Hepner and I have shared a timeshare at Banyan Bay since 2006. My partners attempted to make a reservation for 2024 and was told our timeshare had been abolished. I signed a 94 year contract with Banyan Bay and don't understand how they can legally discontinue our timeshare without any notice. My partners attempted to contact Lilian Chuc, who was the contact at Banyan Bay for reservations, and have had no response whatsoever. It's my understanding Lilian is the contact person for reservations at Alaia, the new establishment. If you would like to pursue this matter as a group to find out what legal rights we have as timeshare owners, I would appreciate it! I believe we would be stronger and have more knowledge as a group than as individuals. I have been in contact with a couple of other timeshare owners to get a better understanding of what's going on. Anyone who has dealt with the new owners and have been compensated, please email me with any information you may have to help the rest of us. I contacted a lawyer in Belize, Eduardo Aguilar & Assoc., couple of days ago, a to see what legal rights we may have. I AM still waiting for a response. I was told there was an attorney, Aldo Reyes, that was the lawyer used in 2017 by some timeshare owners and I don't know what the outcome was. Any information anyone may have will be appreciated.

Are you a former timeshare owner at Banyan Bay? Your statement sounded like you have some background in law. Please let me know if you would like to pursue finding out about our legal rights as timeshare owners. Any and all information will help at this point.

Take a look at the 2007 Timeshare Act. In particular, Part IV. I cannot speak definitively on Belizean law. Here in the States generally a timeshare is an interest in real estate. It cannot simply be taken away without compensation. I would have a hard time believing it was any different in Belize. Their law is based on the Common Law, same as the US and other former British Colonies. That's my two cents. lol

I appreciate the information about the 2007 Timeshare Act because it directly relates to Belize...and I appreciate your two cents lol. I have been in contact with Aldo Reyes, a lawyer there in Belize, and from what I understand was the lawyer representing the HOA at Banyan Bay. I thought the same thing about the timeshare I owned at Banyan Bay, a 94 year contract for a timeshare just can't be taken away without compensation. I have been in contact with a couple of other timeshare owners that want to get together to create a group of us to receive legal advise on how to get compensation for the termination of our timeshares by Banyan Bay. Good luck to you. I thought that sounded very wrong when I first heard of it.
